The 2026 NFL campaign kicks off on Wednesday, Sept. 9 with a rematch of the Super Bowl between the New England Patriots and the Seattle Seahawks. Under the CFTC’s self-certification process , exchanges pitch the introduction of new derivatives with proposed launch dates and if the Commission doesn’t get involved prior to that date, the contracts go live. In the case of the Polymarket NFL injury derivatives, the CFTC didn’t intervene, but there’s talk the derivatives don’t mesh with the regulator’s proposed rules.

“The commission preliminarily believes that event contracts that explicitly settle solely by reference to the duration, severity, occurrence, or medical diagnosis of an injury sustained by a specific athlete raise serious public interest concerns,” according to proposed rules issued by the CFTC.

Both the NBA and the NFL have asked prediction market operators to halt offering event contracts that the leagues view as highly vulnerable to manipulation, including derivatives based on injuries and officiating and what amount to be player proposition wagers.

Concerns About ‘Perverse Financial Incentives’

Injury news is widely watched by bettors and fantasy sports participants and it can take on a life of its own in the NFL where some quarterbacks are worth as much as a point or more to spreads.

As the league and experienced bettors know, there are often moving parts with NFL injury reports and teams withholding details until they’re absolutely required to disclose it is commonplace. Though it allowed the Polymarket contracts, the CFTC acknowledges some of the risks associated with injury-linked event contracts.

“Such event contracts create perverse financial incentives that could encourage or facilitate physical harm to athletes,” notes the commission in its proposed rules update. “Second, the settlement of such event contracts would likely depend on medical diagnoses, which raises public interest concerns about the confidentiality of medical information and the potential for such sensitive information to be leaked or exploited by insiders.”

In its proposed rule changes, the CFTC added that injury reports and physicians’ calls don’t provide a “manipulation-resistant basis for contract settlement.”

NFL Injury Contracts Could Be Problematic

The prediction market industry has endured multiple public relations flaps regarding how some contracts have been settled, indicating there’s risk in offering NFL injury derivatives due to the murkiness often tied to injury reports.

Likewise, the industry has dealt with a spate of insider trading allegations and cases . Some critics believe NFL injury event contracts are recipes for problems on the insider trading front, speculating that NFL trainers and team doctors could be vulnerable to manipulation by bad actors due to the sensitive, player-specific information they control.
